This Agreement ("Terms") sets out the terms and conditions that govern your use of BusinessNeeds (Pty) Ltd products and services (such as website services), as well as any other services and/or goods offered by BusinessNeeds.

1. and such other URLs that we may indicate from time to time ("Website(s)"), which are incorporated by reference into these Terms: Privacy Policy, POPI Website Policy, Website Terms of Use, and any other policy as is made available on our Website(s) and/or User System from time to time ("Policies").

BY ACCESSING OR USING THE SITE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH BELOW. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU MAY NOT ACCESS OR USE THE SITE. BusinessNeeds Online™ MAY MODIFY THIS AGREEMENT AT ANY TIME, AND SUCH MODIFICATIONS SHALL BE EFFECTIVE IMMEDIATELY UPON POSTING OF THE MODIFIED AGREEMENT ON THE SITE. YOU AGREE TO REVIEW THE AGREEMENT PERIODICALLY TO BE AWARE OF SUCH MODIFICATIONS AND YOUR CONTINUED ACCESS OR USE OF THE SITE SHALL BE DEEMED YOUR CONCLUSIVE ACCEPTANCE OF THE MODIFIED AGREEMENT.

BusinessNeeds Online™ will not be held liable for any errors, misinterpretation or any omissions on this website www.businessneeds.co.za or www.cipcregistration.co.za. We will ensure that all will be done from our side to keep all information on this website relevant and correct.

1. Important Notice:

1.1 These Terms and Conditions apply to users who are consumers for purposes of the Consumer Protection Act, 68 of 2008 (the “CPA").
1.2. Further, these Terms and Conditions sets out the Protection of Personal Information Act, 4 of 2013 compliance measures (“POPI").
1.3. These Terms and Conditions contain provisions that appear in similar text and style to this clause and which -
Any information supplied to us by the user can not be verified due to our workload. We therefore will not be held liable for data incorrectly entered by the user on our system. The user must ensure that ALL spelling are correct before submitting data on our website. BusinessNeeds Online™ main method of communication is email. Due to the nature of the internet BusinessNeeds Online™ will not be held liable for any loss of business due to emails not received or read by the client send from BusinessNeeds Online™.
1.4 BusinessNeeds are the dependant on the workload of CIPC (CIPRO) and all registration times might vary accordingly

2. Refunds

All amounts paid to BusinessNeeds Online™ is NON Refundable and will not be refunded if we've already started with any work request. If we find any information supplied to be misleading, false and wrong or the intention is there of doing illegal dealings, we reserve the right to cancel any such applications. Company Registrations can be cancelled if not fully registered with a 50% refund. Refund of 50% will be applicable within 6 months of making the payment for a registration. Failure to submit the required documents within 6 months of making payment will result in no refund.

2.1 This policy applies to the return of goods and/or services, bought from us, BusinessNeeds (Pty) Ltd ("BusinessNeeds") by you (“the consumer").
2.2 BusinessNeeds does not provide refunds unless in accordance with the applicable legal provisions and/or instead offers the consumer with credit on his/her account to be used on any future service requirements as provided for by BusinessNeeds.
2.3 All refunds are subject to internal Anti-money laundering protocols.
2.4 All refunds may be subject to incidental costs (e.g. bank charges etc), which will be withheld from the refund amount.
2.5 BusinessNeeds reserves the right to determine the value of such credit. In the event that any work was commenced in accordance with the applicable service, BusinessNeeds further reserves the right to withhold an amount of 50% of the total invoice from the value of such credit being provided.
2.6 Where the services and/or goods in question are not defective or where you do not have a statutory right to return goods, BusinessNeeds may, in its sole and absolute discretion, elect to accept returns and replace the services and/or goods in question or refund the consumer. Where BusinessNeeds does so, this is done so in good faith. It is not an admission of liability, nor should it be taken as an acknowledgement that the BusinessNeeds will accept similar returns on the same basis in the future.
2.8 BusinessNeeds:

2.8.1 does so in its sole and absolute discretion in each instance; and
2.8.2 may, in its sole and absolute discretion, elect whether to replace the services and/or goods or refund the consumer.

Customer Privacy policy BusinessNeeds shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). 3. Payment options accepted
Payment may be made via Visa, MasterCard, Diners or American Express Cards or by bank transfer into the BusinessNeeds bank account, the details of which will be provided on request.

4. Card acquiring and security
Card transactions will be acquired for BUSINESSNEEDS (PTY) LTD via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

5. Customer details separate from card details
Customer details will be stored by BUSINESSNEEDS (PTY) LTD separately from card details which are entered by the client on DPO PayGate’s secure site. For more detail on DPO PayGate refer to www.paygate.co.za.

6. Merchant Outlet country and transaction currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

7. Responsibility
BUSINESSNEEDS (PTY) LTD takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

8. Country of domicile
This website is governed by the laws of South Africa and BUSINESSNEEDS (PTY) LTD chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, 154 KROONAREND STREET MAGALIESKRUIN PRETORIA 0182.

9. Variation
BUSINESSNEEDS (PTY) LTD may, in its sole discretion, change this agreement or any part thereof at any time without notice.

12. Additional Info :
The Registrar reserves an Approved Company Names for 6 months ONLY. It is the responsibility of the client to send us the necessary original signed documents within this 6 month period in order for us to finalize the registration process. The apporved Company name will expiry, should BusinessNeeds Online™ NOT receive all required original signed documentation from the client as stated in our communication with the client. The client(s) will then have to pay an additional fee within 2 weeks in order to re-submit the expired name. Failure to do so within this 2 week time limit will cause the whole application to expire, and the client(s) will then have to re-apply at FULL COST for the registration of a new Company.

Any application for the Amendment of a Close corporation or Company that requires documents from the clients, WILL expire if these documents are outstanding for more than 2 months.

BusinessNeeds™ is not responsible for the running of a newly registered Company, this will be the responsibility of the members.
We advise all our clients to ask for a second opinion should they be unsure about any information provided by us on this website.
Any software or information downloaded, used or obtained through the use of our website is completely done at your own risk. We will not be held liable for any damages to your computer system, related hardware, software, accessories,loss of any data, business or capital whatsoever.
